§ 1 Scope and Contracting Party
These Terms and Conditions apply to all contracts for the purchase of artworks, editions, prints and catalogues concluded via park-arts.com between Moon Kwan Park (Hansastraße 19, 76189 Karlsruhe, “Seller”) and the buyer. As the works offered are unique pieces or limited editions, contracts are generally concluded through an individual enquiry and confirmation. The information on this website constitutes an invitation to submit an enquiry (invitatio ad offerendum), not a binding offer.
§ 2 Formation of Contract
By submitting the enquiry form, you express a non-binding interest in a work. The Seller will then confirm availability, price and shipping conditions individually by email. The purchase contract is concluded only upon the Seller’s express order confirmation and receipt of full payment or an agreed deposit.
§ 3 Prices & Payment
Unless otherwise stated, all prices are final prices in euros. As Moon Kwan Park may be subject to the German small-business regulation under § 19 UStG, VAT may not be shown separately; this will be stated in the order confirmation. Payment is made by bank transfer, PayPal or cash upon studio collection, as agreed. For works marked “On request”, the price will be quoted individually.
Instalment payments over 3–12 months may be arranged on request. Details will be set out in a separate written agreement. Ownership of the work passes to the buyer only after full payment has been received (retention of title pursuant to § 449 German Civil Code).
§ 4 Shipping & Delivery
Works are professionally packed to art-shipping standards and sent fully insured. Unless otherwise agreed, delivery usually takes 5–10 working days within the EU and 10–20 working days for international shipments outside the EU. Shipping costs depend on the size, weight and destination of the work and will be communicated individually before the contract is concluded. Collection from the Karlsruhe studio is free of charge by appointment.
For shipments to consumers, the risk of accidental loss or deterioration passes only upon delivery to the buyer, regardless of whether the shipment is insured (§ 475(2) German Civil Code).
§ 5 Right of Withdrawal (14 Days)
Consumers have a statutory right of withdrawal for 14 days from receipt of the goods. To exercise this right, an informal notice by email or letter to the Seller is sufficient. The goods must be returned in their original condition and securely packed. The Seller will provide a return label or reimburse the return shipping costs. In the event of a valid withdrawal, the purchase price will be refunded within 14 days using the same payment method as the original transaction.
The right of withdrawal is excluded for works made to the customer’s specifications or personalised works, such as commissions or works with a personal dedication, pursuant to § 312g(2)(1) German Civil Code.
§ 6 Authenticity & Characteristics of the Works
Every original is supplied with a certificate of authenticity hand-signed by the artist. As the works are handmade unique pieces, slight variations in colour, texture and surface compared with the website image may occur. These do not constitute defects but reflect the individual painterly technique. Dimensions may vary by up to 1–2 cm for production-related reasons.
§ 7 Warranty
Statutory warranty rights apply. For consumers, the warranty period for used or aged works, including older catalogue works, may be limited to one year where legally permissible; for newly acquired originals, the statutory two-year period applies.
§ 8 Copyright
The purchase of an artwork transfers ownership only of the physical object. Copyright and rights of use, including reproduction, duplication and publication rights, remain with the artist Moon Kwan Park under the German Copyright Act (UrhG), unless expressly agreed otherwise in writing.
§ 9 Dispute Resolution
The European Commission provides an online dispute resolution platform, available at ec.europa.eu/consumers/odr. The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 10 Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If individual provisions of these terms are invalid, the remaining provisions remain unaffected.
